Do not sleep on your rights!

My Mother is one of the registered owner as declared on the OCT with a Homestead Patent issued in 1965.She's quite old and unaware of what and how it happened when a developer was able to "snatched" the titled land from my Father who passed away 10 years ago. Now that we (the children) are all grown and asked what happened to the land, my Mom could hardly recall. We found the copy of the OCT and four other TCT's that arose from it. All annotations on the back of the TCT's were carefully analyzed and just does not seem to jive so now we are trying to find some answers.At some point,the land was auctioned off and my father had issued a restraining order to not issue a TCT to the highest bidder for he has the right as a registered owner for the redemption of the same. Two years later, a consolidation of ownership was noted and five months prior to consolidation, a deed of sale was done by the highest bidder to the new owner and was issued a TCT. The consolidation and the deed of sale were both inscripted on the same day, same time and the same year.  Could there have been some hocus focus in the local Register of Deeds? The new owner had started developing the land since then (about 30 years ago now) and I found out that there are 3 model homes built. They were able to subdivide the land into 600 lots, got copies of the title of 600 lots, read and analyzed, 1/3 were sold, a few were mortgaged, and 1/3 tax levied and a part on joint venture. I have talked to a few people who already had paid for the lot but said that they can not get the title of their paid lot. What do you think is going on why they cannot issue the title? Gawing mong mas malalim ang iyong pagsasaliksik. Huwag kang makontento sa pagtingin sa mga titulo lamang.  Ayon sa iyong salaysay, ikaw ay nagsususpetsang inagaw ng developer ang titulo ng lupaing nakatitulo sa iyong ina.  Humingi ka ng kopya ng deed of sale sa pagitan ng iyong ina at ang developer mula sa Register of Deeds sa inyong lugar.  Ang deed of sale na iyon ang basehan ng Register of Deeds na kanselahin ang OCT ng nanay mo at mag-isyu ng apat na TCT ang Register of Deeds. Dahil naging apat, malamang ng mayroong approved survey plan na ibigay ng developer sa Register of Deeds.

Ayon sa iyong salaysay, maaaring ang lupain ng iyong ina ay naisanla kaya dumaan sa foreclosure proceedings sa korte kaya nakahingi ng restraining order ang tatay mo na huwag mag-issue ng TCT dahil mayroon siyang right of redemption.  Ngunit ang right of redemption ay dapat gawin sa loob ng isang taon pagkatapos ng foreclosure sale.  Kung hindi matubos sa loob ng isang taon, mag-iisyu ang korte ng consolidation and deed of sale sa highest bidder at mairegistro nang siya ang bagong may-ari.

Dahil nga developer ang bagong may-ari, pina-subdivide niya sa maliit ng parsela ang lupa para medaling ibenta.  Ang maaaring dahilan kaya hindi maibigay ng developer ang titulo sa mga nakabili na fully paid na ay dahil ang titulo ng lupa ay naisanla para gamitin sa pagpadevelop ng lupa.  Hanggat hindi nababayaran ang utang, hindi rin muna matutubos sa pagkasanla.
