Tax Declaration as proof of ownership

My mother has a tax declaration of the land can he own it?
Question: My Mother has her inherited 1 hectare piece of land, but the problem is her inherited land was on the side of his father's brother because his father was given additional piece of land, because he is the one who planted the coconut trees and he is the oldest brother and my mother has the tax declaration of the land named to her. One day the children of her father's brother was wondering why there was a piece of land inserted in there land, and that was my mother's land. They have the land title as a whole but they are planing to subdivide it and have it titled but the problem is they recognized that my mother's land was inserted in there piece of land.
Question: can my mother owns the land since she has the declaration and she has the right since that was given to her my his father with declaration named to her, but she have not yet have it titled. do we have the right of this land.  please give me some advice on this matter.

Ayon sa iyong salaysay, ang inyong ina ay may lupaing may tax declaration.  Kaso lumalabas na ang lupaing ito ay napapaloob sa titulo ng kanyang tiyuhin.  Mabuti lang at kinikilala ang sitwasyong napapaloob sa kanilang titulo ang lupain ng inyong ina na may documentong tax declaration.
Sa ganyang sitwasyon, kailangang ipa-survey ang nasabing lupain para ma-subdivide.  Dahil kinilala nila ang
lupa ng inyong napaloob sa kanilang titulo, kailangang malaman sa pamamagitan ng surveyor ang mga boundaries ng lupa ng inyong ina na nakasaad sa tax declaration.  Dapat ang survey plan ay ipa-approve sa Bureau of Lands.  Ang nasabing approved survey plan ang basehan ng Register of Deeds para ipangalan sa inyong ina ang lupaing naihiwalay sa pamamagitan nito.  Dahil nga kinikilala ng kanyang tiyuhin ang pagmamay-ari ng inyong ina na nasa loob ng kanila titulo ang lupain ng inyong ina, sila dapat ay lumagda sa isang Deed of Reconveyance na pabor sa inyong ina.
Ang approved survey plan at ang Deed of Reconveyance ang basehan ng Register of Deeds para magbigay ng titulo sa inyong ina at ang ibang bahagi ay ibibigay sa mga anak ng tiyuhin ng inyong ina.

I would like to enquire about some properties we own in the Philippines. As a nearly-to-retire couple, my wife (a Filipino citizen) and I (a naturalized Danish citizen)had plan of staying in the Philippines during winter time, and in Denmark during summer. So in 2003, we both agreed to make a huge loan, making our house in Copenhagen as collateral, to pay in full two (2) small condominium units in the Philippines. Diagnosed of breast cancer in 2004, my wife passed away in the year 2010 leaving no testaments.

Given the above mentioned information, I would like to ask some questions related to the given facts above, and at the same time I would like to solicit for your advice.
1. Are the two small condominium units which we bought out of the huge loan we made in Copenhagen considered conjugal properties? If so, will the properties be automatically transferred to me? 
2. I was informed by a close family friend of my wife that my in-laws have also the right over the two small condominium units because we do not have children and I have renounced my Filipino citizenship and became a Danish citiozen. Is this correct?

Sa unang katanungan:  Ang dalawang maliliit ng condominium units ay maituturing na conjugal properties ninyong mag-asawa.  Pero kung kayo ay ikinasal pagkatapos ng taong 1987, ang mga ito ay naging absolute community of properties ninyong mag-asawa.  Bilang asawa, ikaw ay may-ari ng kalahati ng conjugal properties o ng absolute community property. 

Maliban dito, ikaw ay tagapagmana rin ng iyong yumaong asawa sa natitirang kalahati.  At ayon sa batas, kung ang naiwang tagapagmana ay asawa at mga magulang ng yumao, ang nabubuhay ng asawa ay may mamanahin ika-apat na bahagi ng kayamanan ng yumao at ang natitira ay pupunta lahat sa kanyang magulang.

Sa pangalawang katanungan:  Totoong may karapatang magmana ang iyong biyenan sa mga kayamanang naiwan ng kanilang anak ngunit dahil ito ay conjugal properties kailangang bawasin muna ang kalahati na iyong pag-aari bilang partner ng yumao.  Ang natitirang kalahati naman ang kayamanan ng yumao kung saan manggagaling ang mamanahin ng kanyang mga magulang.  Ang natitirang buhay na asawa ay magmamana ng ika-apat na bahagi sa kayamanang iniwan ng kanyang asawa.

Ikaw bilang dating Filipino na ngayon sa isang Danish ay may karapatang magmay-ari ng lupain sa Pilipinas na ang limitasyon ay 3 hectares of rural agricultural land at 1,000 square meters of residential land.

It is good to have witnesses in every transaction

i am hoping that you could help me and enlighten me on this. My mother died without a last will and testament. When she was still alive we only rented the land for many years, but when the owner was ready to sold the property my brother paid for the land for that time he was the one who had the money. He paid for the land but the receipt was not on his name but my mother and there was a document that my other two sisters signed as a witness that they paid for the land. I have 8 sibblings. My mother died and my brother said he owned the land. He has paid for the gains tax. so, is he really the legal owner of the land? Please do help me clarify this issue, for my family is in real danger right now.

Ayon sa iyong salaysay, ibinenta sa pamilya ninyo ang lupang matagal ninyong sinasaka.  At dahil ang kuya mo ang may pera, siya ang bumayad sa may-ari ng lupa.  Kung ito ay ipinagkaloob sa pamamagitan ng agrarian reform, maaari nating sabihin na ang nabigyan ng titulo ay ang inyong ina.  At testigo ang dalawa mong kapatid na babae na ang bumayad sa lupa ay ang inyong lalaking kapatid.

Kung ang titulo ang pagbabasehan, ang may-ari ay kayong walong magkakapatid dahil kayo ay magmamana sa inyong yumaong ina kung kanino ang titulo ng lupa ang nakapangalan.  Nguni’t dahil ang bumayad sa dating may-ari ay ang inyong lalaking kapatid, inyo dapat kilalanin ang kanyang pag-aari dahil may dalawa kayong kapatid na nagpapatunay na siya mga ang bumayad para dito.  Kung sakaling ang titulo nga ay nakapangalan sa inyong ina, kailangan ninyong walong magkakapatid ang pumirma sa isang Extrajudicial Settlement of Estate with Quitclaim para mailipat pangalan ng titulo sa kapatid ninyong bumayad sa halaga ng lupa.
